We believe it is important for our users to understand this Privacy Policy, so we have written it as plainly as possible without all of the legalese!

Our company, Profound Public Benefit LLC, is based in Austin, TX. We will refer to the company as "we", "our", "ours", or "us" in the rest of this document. We will refer to the AI therapist as "Profound" in the rest of this document.

This Privacy Policy explains how we collect, use, store, and share your information when you use our app (“Services”). By using our Services, you agree to the collection and use of your information in accordance with this policy.

1. Information We Collect

Personal Information

  • Name: We collect your first name to create a personalized experience. This allows Profound to address you by name. If you prefer, you can use a nickname or alias instead.
  • Date of Birth: We collect your date of birth so that Profound can tailor the experience to your age. Additionally, Profound will remember and celebrate your birthday. If you prefer, you can provide an approximate date of birth instead.

Application Data

  • Conversations with Profound: All conversations with Profound - both text and audio - are transmitted and stored with industry-standard encryption (in transit and at rest). These conversations are stored exclusively for the purpose of Profound's ability to remember your interactions with you and understand you personally. These conversations are never read by humans, shared with or sold to any third parties, or used for ads. The only time a human will read your conversations is if we are legally required to do so to comply with a subpoena or other legal process. We are working on developing legal support for therapist-client privilege to defend against this.
  • Assessments: Assessment results are stored securely to keep track of your mental health indicators over time and to allow Profound to know how you're doing.
  • Modules: Module data like journal entries, mood check ins, etc are stored securely to retain your history and to allow Profound to understand you better.
  • Courses: Course progress and completion is stored securely to keep track of your progress and to allow Profound to understand and discuss your growth.
  • Usage Data: We collect information about how you use our Services, including assessments, modules, and other interactions in the app.

Technical Information

  • Device Information: We collect information about the device you use to access our Services, including device type, operating system, and unique device identifiers. This information is used to improve our Services (ex: Are certain device types experiencing bugs? Are certain device types experiencing lower engagement?) and to prevent abuse (ex: Is there an unusually high amount of activity from a specific device?). We never use device information for any other purposes besides these. We never share device information with third parties.
  • Log Data: Our servers automatically record information (“log data”) created by your use of our Services. Log data includes information like how long it took for a request to reach our servers from your device. We only use this information to ensure that our service is working properly.

2. How We Use Your Information

Personalization

Profound uses your conversation history, app usage data, and any personal information you provide to respond to you in a way that is completely personalized to you, like a close friend or therapist.

Improvement of Services

We use a system based on Clio to improve our service without showing any conversations to human analysts. Profound uses a bottom-up aggregation approach to distill conversations into abstracted, understandable topic clusters while preserving user privacy. Security

We use app usage data to monitor and enhance the security of our Services, including identifying and addressing vulnerabilities.

3. How We Share Your Information

With Third Parties

We do not share, sell, or trade your personal information with third parties for marketing purposes. We utilize third party service providers like cloud service providers and payment processors to enable our Services.

For Legal Reasons

We may disclose your information if required by law, such as in response to a subpoena, or if we believe that disclosure is necessary to protect our rights or comply with a judicial proceeding. We are working on developing legal support for therapist-client privilege to defend against this.

4. Data Storage and Retention

Storage

We use encryption when we transmit and store your data to protect against unauthorized access, disclosure, alteration, or destruction.

Retention

We retain data indefinitely unless a deletion request is made.

5. Your Rights

Access and Correction

You have the right to access the personal data we hold about you and to request corrections if the data is inaccurate or incomplete.

Deletion

Personal data can be fully deleted at any time in the app with no fuss.

6. AI Models

We utilize a diverse mix of commercial, proprietary, and open source AI models to provide our Services. In any situations where we use commercial models, we do not allow the provider access to train on your data. Any commercial model providers that we work with treats your data as Personal Health Information ("PHI") and complies with HIPAA regulations as it relates to your data.

7. Security Measures

We implement a variety of security measures to protect your personal information, including encryption, secure access protocols, and regular security audits. Despite these efforts, no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee its absolute security.

Our Services are available to anyone over the age of 13. Users under the age of 18 must obtain parental consent before using our Services. By using our Services, you acknowledge that you meet the age and parental consent requirements.
