We believe it is important for our users to understand these Terms of Service, so we have written them as plainly as possible without all of the legalese!

Our company, Profound Public Benefit LLC, is based in Austin, TX. We will refer to the company as "we", "our", "ours", or "us" in the rest of this document. We will refer to the AI therapist as "Profound" in the rest of this document.

These Terms apply to all users globally.

1. Eligibility

Our Services are available to anyone over the age of 13. Users under the age of 18 must obtain parental consent before using our Services. By using our Services, you acknowledge that you meet the age and parental consent requirements.

2. User Accounts

  • Personal Information: We collect your first name and date of birth so that Profound can address you by name, tailor your interactions to your age, and remember your birthday. If you prefer, you can use a nickname, alias, or approximate date of birth.
  • Individual Use: Each account is intended for personal use to maintain accurate records of your therapeutic progress and avoid mixing information belonging to different individuals.

3. Subscription

  • App Store Subscription: We offer a subscription through the app store (iOS or Google Play). A 1-week free trial may be available to new users.
  • Refunds: We offer a full refund guarantee if, after using the app, you believe it hasn't supported your mental health goals within the first month of use. Please contact us at [email protected] if you need to request a refund.
  • Subscription Renewal: Subscriptions renew automatically unless canceled before the start of the new billing period. Cancellation must be done through the app store. Partial refunds may be granted at the discretion of our customer service team during a billed period.

4. App Usage

  • Intended Purpose: Users must use the app only for its intended purpose of personal growth, therapy, and well-being. Any misuse, including attempts to circumvent restrictions, botting, or abusing the service, is strictly prohibited.
  • Usage Threshold: App usage may be limited to a fixed expense threshold. Once this threshold is reached, users may purchase additional credits to continue using the service.

5. Security & Penetration Testing

We welcome responsible security experts to identify legitimate vulnerabilities. If you wish to conduct penetration testing, you must take steps to limit exposure of personal user data. You must not engage in DDoS testing. You should provide us a reasonable amount of time (approximately 90 days) to remedy vulnerabilities before publicly disclosing them. 6. Content and Intellectual Property

User-generated content, including transcriptions of audio recordings and text-based conversations with the AI therapist, will be stored securely using encryption. This content is never shared with or sold to third parties. In accordance with our privacy practices, you may request access to or deletion of your data at any time.

7. Data Privacy

We do not share, sell, or trade your personal information with third parties for marketing purposes. We store your therapy data indefinitely unless a deletion request is made. For further details on data handling and privacy, please refer to our Privacy Policy.

8. Liability and Disclaimers

While we have implemented guardrails to ensure the accuracy and helpfulness of AI-generated content, we are not liable for any errors, inaccuracies, or misleading information. We continuously monitor and improve our systems to address any detected issues. Profound is not a substitute for emergency medical services or in-person mental health services. 9. Modification and Termination

  • Account Termination: We may suspend or terminate any account if we detect misuse or abuse of our services.

10. Dispute Resolution

  • Arbitration: In the event of a dispute, you agree to resolve it through binding arbitration under the rules of the American Arbitration Association (AAA) in Austin, Texas.
  • Class Action Waiver: By agreeing to these Terms, you waive your right to participate in class action lawsuits against us.

11. Compliance with Legal Requirements

We comply with all relevant U.S. laws and regulations. We do not knowingly provide our services to users in countries or regions where such services are prohibited by U.S. law.
